This development comes after a formal complaint was lodged against him by the Hind Rajab Foundation (HRF), seeking his immediate arrest for his role in the brutal destruction of civilian areas in Gaza.<\/p>\n

Evading Justice: The Flight of a War Criminal<\/span><\/h2>\n

According to legal sources closely involved with the case, Gilboa, a member of the Israeli occupation regime’s 271st Combat Engineering Battalion, is believed to have departed India just days after the complaint was filed. The HRF, a Brussels-based organization, had formally requested Indian authorities to apprehend Gilboa for his alleged involvement in atrocities against the Palestinian people in Gaza, a region recognized by the United Nations and numerous human rights bodies as experiencing a genocide.<\/p>\n

The organization presented compelling evidence, including videos and photographs shared by Gilboa himself on social media, documenting his participation in the demolition of residential areas. These images starkly depict Gilboa ordering and celebrating the destruction of civilian homes in Khan Younis and Rafah, actions that unequivocally violate the Fourth Geneva Convention and constitute grave war crimes under international law, including India\u2019s own Geneva Conventions Act, 1960.<\/p>\n

“Eitan Gilboa is not merely a tourist; he is a war criminal shamelessly enjoying India’s hospitality while escaping accountability for his monstrous crimes,” stated Dyab Abou Jahjah, HRF General Director. He further emphasized that New Delhi must not allow its territory to become a sanctuary for those who revel in the annihilation of innocent lives.<\/p><\/blockquote>\n

India’s ‘Tepid’ Response: Aiding Impunity?<\/span><\/h2>\n

The HRF’s complaint against Gilboa is part of a broader global campaign to investigate and prosecute alleged Israeli war criminals. Since its inception in 2024, the HRF has filed over 90 criminal complaints across 30 jurisdictions, highlighting the widespread nature of these crimes and the international demand for justice.<\/p>\n

India, along with Thailand and Sri Lanka, has unfortunately become a favored destination for Israeli military personnel post-service, with tens of thousands reportedly visiting annually. Gilboa, born in an illegal Israeli settlement in Gaza, participated in the Israeli aggression on the enclave following the October 7, 2023, events. He was later spotted vacationing in Old Manali and Gondla village in Himachal Pradesh.<\/p>\n

Despite India’s clear obligations under the Geneva Conventions Act of 1960, the government’s response to the serious allegations has been alarmingly “tepid.” A lawyer involved in the case expressed disappointment, noting that the only official communication received was an email from the Bureau of Immigration requesting contact details, with no subsequent follow-up or concrete action.<\/p>\n

Deepening Complicity: India-Israel Ties Amidst Injustice<\/span><\/h2>\n

Reports indicate that the complaint was forwarded to the Foreigners Division of the Ministry of Home Affairs, responsible for visa cancellations. However, no action was taken within the period allotted for deportations, effectively allowing Gilboa to escape justice.<\/p>\n

This inaction is particularly concerning given the burgeoning ties between India and the Zionist entity. Earlier this year, relations were elevated to a “Special Strategic Partnership for Peace, Innovation & Prosperity,” underpinned by significant military and economic agreements. This partnership, which includes efforts to expand tourism, appears to prioritize political expediency over international justice and human rights.<\/p>\n

The Israeli government, including Prime Minister Benjamin Netanyahu, has repeatedly lauded New Delhi’s diplomatic support. India’s refusal to endorse South Africa’s genocide case against Israel at the International Court of Justice (ICJ) and its continued supply of military components to the occupying regime further underscore its complicity. An Al Jazeera analysis revealed India among the top five countries supplying military-related goods to Israel since the ICJ ruling in January 2024.<\/p>\n

The international community watches as India, a nation with a rich history of advocating for justice, seemingly turns a blind eye to grave war crimes, allowing its soil to become a refuge for those accused of perpetrating genocide against the Palestinian people.<\/p>\n
